Acceptable Use Policy
This Acceptable Use Policy is part of your Terms of Service with Custom Software Solutions LLC. Because Brimkyhosts sites under managed infrastructure (which itself is subject to upstream provider rules), customer conduct can affect our hosting account — so the rules below are strict.
1. Illegal activity and security abuse — strictly prohibited
- Malware, viruses, worms, ransomware, malicious scripts
- Credential theft, phishing pages, fake login pages
- Botnets, hacking tools, unauthorized access tools
- Denial-of-service activity, port scanning, brute-force tooling
- Spam, scam pages, impersonation, fraud
- Malicious redirects, cloaking, evasion of security tools
- Any activity violating U.S. or Delaware law
2. Intellectual-property abuse — strictly prohibited
- Copyright infringement (see our DMCA & Trademark Policy)
- Trademark infringement, including counterfeit logos and brand impersonation
- Counterfeit goods
- Pirated media or software
- Scraped content used unlawfully
- Unauthorized use of photos, logos, fonts, music, or videos
2b. Deceptive advertising, reviews & endorsements
Subject to (and further detailed in) our Advertising, Reviews & Testimonials Policy, the following are prohibited:
- Fabricated, fake, or AI-generated reviews presented as genuine
- Undisclosed paid, incentivized, employee, or family reviews
- Suppression of genuine negative reviews to distort the overall picture
- Reusing reviews from unrelated products or businesses as if they were the Client’s
- Fake negative reviews of competitors
- Undisclosed celebrity, professional, or influencer endorsements
- Fake countdown timers, fake “only N left” messages, or other persistent fake-scarcity / fake-urgency tactics
- Unsubstantiated results, earnings, weight-loss, or treatment-outcome claims
- Misleading before/after photos (different subject, altered lighting, retouched without disclosure)
- Misleading comparative claims about competitors
- Bait-and-switch pricing or discounts
3. High-risk content and businesses — written approval required
The following are prohibited unless we have approved them in writing in advance:
- Adult content
- Gambling
- Cryptocurrency or investment schemes
- Payday lending
- Supplements making medical claims
- “Medical cures”
- Weapons
- Illegal drugs
- Tobacco or nicotine
- Political spam
- Mass lead generation
- Get-rich-quick claims
- Multi-level marketing
- Deceptive “limited time” offers
- Regulated financial, legal, or medical claims
4. Technical abuse — strictly prohibited
- Crypto mining
- File-storage dumps, backup archives, or media warehousing
- Proxy, VPN, or Tor relay services
- Mass-email infrastructure or warm-up schemes
- Resource abuse (excessive CPU, RAM, disk, or bandwidth)
- High-volume scraping or data harvesting
- Unmanaged scripts or untrusted executables
- Bypassing the CMS, security controls, or admin systems
- Insecure plugins, scripts, or third-party integrations
- Attempts to access other customer sites or accounts
5. Email and outreach
Client may not use the Services to send unsolicited bulk email, host spam-advertised pages, operate phishing pages, spoof headers, or support spam-related activity. Bulk marketing email must be sent via a dedicated provider (Mailchimp, Brevo, etc.) — not through Brimky’s hosting stack.
6. Upstream provider compliance
Client’s use of the Services is subject to applicable upstream provider policies, including hosting-provider acceptable-use, resource, abuse, and anti-spam policies. We may immediately suspend services where Client conduct threatens our upstream provider relationships.
7. Enforcement
We may remove content, disable features, block traffic, suspend sites, throttle resources, terminate accounts, report abuse, or cooperate with providers, payment processors, law enforcement, or rights holders where we believe necessary. Where Client activity threatens our hosting account, network reputation, payment processing, security, other customers, or upstream provider relationships, we may act immediately and without notice.
8. Reporting abuse
To report abuse on a Brimky-hosted site, email [email protected]. Include the URL, the nature of the abuse, and any supporting evidence. For copyright complaints, use our DMCA Policy instead.
